July 2 (Reuters) - A U.S. judge on Tuesday said he would
reduce an $80 million damage award against Bayer AG BAYGn.DE
to $50 million or less in the case of a man who blamed his
cancer on glyphosate-based weed killer Roundup.
U.S. District Judge Vince Chhabria in San Francisco said the
jury's $75 million punitive damages award to plaintiff Edwin
Hardeman in March could not stand.
"It's quite clear that under the Constitution I'm required
to reduce the punitive damages award and it's just a question of
how much," Chhabria said during a court hearing in which lawyers
for both sides discussed the company's request to overturn the
verdict. Chhabria said he would issue a ruling by the end of
next week.
Following a four-week trial, a federal jury on March 27
awarded $5 million in compensatory and $75 million in punitive
damages to Hardeman, who was diagnosed with non-Hodgkin's
lymphoma in 2014.
U.S. Supreme Court rulings limit the ratio of punitive to
compensatory damages to 9 to 1.
Chhabria said he was also considering reducing the
compensatory damages award because Hardeman was now in full
remission and unlikely to suffer as much as he had in the past.
Bayer, which bought Roundup maker Monsanto for $63 billion
last year, says Roundup and its active ingredient glyphosate are
safe for human use and not carcinogenic.
The company faces lawsuits by more than 13,400 plaintiffs
nationwide and a series of Roundup jury verdicts against Bayer
have prompted its share price to plummet. Under pressure from
activist shareholders, Bayer on Wednesday said it set up a
committee to help resolve the litigation and hired an external
lawyer to advise its supervisory board.
Bayer had asked Chhabria to completely reverse the jury
verdict in Hardeman's case in light of scientific evidence and
assessments by regulators finding glyphosate to be safe.
Brian Stekloff, a lawyer for Bayer, on Tuesday said Monsanto
went "above and beyond" to meet regulatory requirements,
warranting a complete reversal of the punitive damages award.
But Chhabria disagreed, saying jurors had seen sufficient
evidence that Monsanto did not care whether its products cause
cancer, instead focusing on undermining people who were raising
concerns.
"There was nothing suggesting that anybody at Monsanto
viewed this issue objectively or with any consideration for the
life of human people," the judge said.

Ik weet niet precies hoe die jury's in de US worden samengesteld maar het voelt toch allemaal wat aan dat het vooral gebaseerd is op emotionele beslissingen... Ik zeg niet dat alle juryleden dommeriken zijn, maar mijn inziens dient vooral de wetenschap vanuit diverse oogpunten een oordeel te vellen. Hoe kan een leek in godsnaam hier wat over zeggen. Echt vreemd.

Hoe komt het dan dat tabaksfabrikanten nog in de lucht zijn, daar staat de boodschap zelfs op het pakje en toch geen miljardenclaims... voelt allemaal wat onlogisch aan op dit moment.

Bayer shares up 1.8% trade after U.S. Roundup rule


FRANKFURT (Reuters) - Shares in German chemicals company Bayer <BAYGn.DE> rose 1.8% in early trade on Tuesday after a U.S. judge slashed a damages award Bayer owes a California man who blamed its Roundup weed killer for his cancer.

Broker Lang & Schwarz said premarket trades had seen the stock up 4.2%. The stock had fallen 6.5% so far this month.

The judge said evidence against the former Monsanto Co, which Bayer bought last year, supported punitive damages over the glyphosate ingredient contained in Roundup but reduced damages to $20 million from $75 million.

A Frankfurt-based trader said that in his view early Tuesday gains were not sustainable.

"Next Glyphosate trials will start in August," he said. "Bayer will only see an ongoing recovery when it enters mediation talks to settle the 13,400 claims."

Germany's DAX <.GDAXI> was 0.06% up.

Rechter wil ook miljardenboete Bayer verlagen

OAKLAND (AFN/BLOOMBERG) - De schadevergoeding van 2 miljard dollar die chemieconcern Bayer aan een koppel in de Verenigde Staten moet betalen wegens het middel Roundup, is te hoog. Dat heeft een Amerikaanse rechter in een voorlopige uitspraak vastgesteld.

Een jury kende de miljardenboete eerder dit jaar toe aan een bejaard koppel, dat stelt kanker te hebben gekregen door blootstelling aan onkruidverdelger Roundup. Maar volgens de rechter is het deel dat als boete geldt te hoog in vergelijking met de schadevergoeding. Bayer zou het koppel daardoor in plaats van 2 miljard dollar 'maar' 250 miljoen dollar moeten betalen. Beide partijen hebben nu de mogelijkheid op deze uitspraak te reageren.

Eerder deze week verlaagde een andere rechter om dezelfde reden al een vergoeding voor een kankerpatiënt. Dat bedrag werd van 80 miljoen dollar verlaagd naar 25 miljoen dollar.

Roundup kwam vorig jaar via de overname van Monsanto in handen van Bayer. Daarmee haalde het Duitse concern zich ook duizenden rechtszaken wegens het middel op de hals. Bayer houdt vol dat Roundup veilig is, maar stelde wel een bemiddelaar aan voor alle claims.

A California judge slashed a more than $2B award against Bayer AG (OTCPK:BAYZF) to $86.7M in a case where a husband and wife each blamed their non-Hodgkin lymphoma diagnoses on the company's Roundup weedkiller.

That's the third large trial verdict that Bayer was able to get reduced in litigation over the safety of Roundup.

Last week, a federal judge in San Francisco reduced a more than $80M verdict to $25.3M.

FRANKFURT (Reuters) - Germany's Bayer <BAYGn.DE> said the next U.S. lawsuit scheduled to be heard over claims that its glyphosate-based weedkiller Roundup causes cancer would likely be postponed.

Bayer, which acquired the weedkiller as part of its purchase of Monsanto last year, was initially scheduled to face its first trial outside California in St. Louis, Missouri, on Aug. 19, brought by Illinois resident Sharlean Gordon, who blames her non-Hodgkin's lymphoma on using Roundup at home.

"We anticipate that this court case will be postponed but we have not received any written decision," a Bayer spokesman said. He would not comment on how Bayer was informed of the delay or on the reason for it.

German weekly Wirtschaftswoche earlier reported the likely delay.

Bayer has seen its market value slashed by about 30 billion euros since August last year, when a California jury in the first such lawsuit found that Monsanto should have warned of the alleged cancer risks.

The company, which says regulators and extensive research have found glyphosate to be safe, is banking on U.S. appeals courts to reverse or tone down the first three court rulings that have so far awarded tens of millions of dollars to each plaintiff.

Bayer has previously flagged two more St. Louis cases due to start in September and October, respectively, but the spokesman on Wednesday said he could not comment on their timing.

Bayer AG is proposing to pay as much as $8 billion to settle more than 18,000 U.S. lawsuits alleging its Roundup herbicide causes cancer, according to people familiar with the negotiations, Bloomberg News reports.
Though such an agreement may be months away, if successful it would ease investor pressure over the German drug and chemical company’s massive litigation exposure. Bayer’s shares have fallen more than one-third in the 14 months since its $63 billion acquisition of the weedkiller’s maker, Monsanto Co.

Dat meldt het persbureau Bloomberg op basis van drie bronnen die betrokken zijn bij de gesprekken. In totaal lopen in de Verenigde Staten ruim 18.000 rechtszaken tegen Bayer. Die processen zijn aangespannen door mensen die zeggen kanker te hebben gekregen door de onkruidbestrijder Roundup te gebruiken.
In augustus vorig jaar kreeg Dewayne Lee Johnson - een tuinman met terminale kanker - Bayer voor het eerst op de knieën. Een Amerikaanse rechter legde het bedrijf toen een boete van 289 miljoen dollar op. Uiteindelijk werd het bedrag wel verlaagd naar 78,5 miljoen dollar. Sinds de zaak Lee Johnson regent het klachten en hebben tal van kankerpatiënten een proces tegen Bayer opgestart.
Een minnelijke schikking lijkt nu in de maak, maar een akkoord is er nog niet. Onderhandelingen daarover zijn bezig in New York. Bayer zou een bedrag tussen 6 en 8 miljard dollar hebben voorgesteld om bestaande en toekomstige rechtszaken af te handelen. Advocaten van de gedupeerden vinden dat naar verluidt niet genoeg en eisen meer dan 10 miljard dollar.

Een belangrijk twistpunt is het bedrag dat moet worden vrijgemaakt voor compensatie van Roundup-gebruikers bij wie nog kanker moet worden vastgesteld. Een definitieve overeenkomst laat daarom mogelijk nog maanden op zich wachten. Wel zouden de gesprekken zo ver gevorderd zijn dat beide partijen hebben gevraagd om uitstel van rechtszaken die binnenkort beginnen.
Bayer geeft geen commentaar. Het kreeg vorige zomer Roundup in handen via de overname van Monsanto. Het legde voor het Amerikaanse landbouwtechbedrijf 63 miljard dollar op tafel, maar veel plezier heeft het aan die investering nog niet beleefd. Integendeel.
Roundup hangt al lang als een zwaar van Damocles boven het hoofd van Bayer. Dat het einde van de miserie voor Bayer in zicht lijkt en dat er eindelijk een bedrag op op wordt gekleefd, klinkt beleggers als muziek in de oren. Het aandeel BAYN2,21% schiet de hoogte in.
